These terms govern your use of Kāhu. Please read them carefully. By using the site you agree to them. If you do not agree, please do not use Kāhu.
Who you are dealing with
Kāhu is operated by Financial Advice NZ Limited, a licensed financial advice provider (FSP1009051). In these terms, “Kāhu”, “we”, “us” and “our” mean Financial Advice NZ Limited. “You” means the person using the site.
- Registered office: [insert street address], Parnell, Auckland [insert postcode], New Zealand.
- Contact: [insert contact email].
Accepting these terms
By accessing or using Kāhu, you confirm that you have read, understood and accepted these terms, our Privacy policy, Cookie policy and Disclaimer. If you use Kāhu on behalf of someone else, you confirm you are authorised to do so.
What Kāhu is
Kāhu is a consumer platform that helps you compare KiwiSaver providers and funds and, where you choose, helps you switch. It scans a wide range of KiwiSaver funds and presents data on matters such as fees, performance and risk so you can compare options in one place.
The financial advice available through Kāhu is provided by Financial Advice NZ Limited as a licensed financial advice provider. Kāhu does not operate a KiwiSaver scheme and is not a KiwiSaver provider. We are not endorsed by, or affiliated with, the New Zealand government or Inland Revenue. Financial Advice NZ Limited uses the KiwiSaver trade mark and logo under licence from Inland Revenue.
General information compared with personalised advice
Much of what you see on Kāhu is general information. General information does not take account of your particular circumstances. It is provided to help you understand your options and to inform, not replace, your own decision.
Personalised financial advice takes your individual circumstances into account. Where we give you personalised advice, we will make that clear and we will provide the disclosure required by law at the relevant stage. Our publicly available information about our financial advice service, including our licensing, the nature and scope of advice, fees, conflicts of interest and how we manage complaints, is available at [insert full disclosure link].
Kāhu is operated by Financial Advice NZ Limited, a licensed financial advice provider (FSP1009051). The information here is general in nature. Personalised financial advice takes your circumstances into account and is provided subject to our full disclosure, available at [insert link]. KiwiSaver involves risk; returns are not guaranteed and past performance and reliability scores do not guarantee future results.
Who can use Kāhu
Kāhu is intended for New Zealand retail clients who are at least 18 years old and resident in New Zealand. By using Kāhu you confirm that you meet these criteria. If you are helping someone who does not meet them, please contact us before relying on any comparison or advice. [Confirm position if KiwiSaver members under 18 are within scope.]
Comparison data and the reliability score
We take care to present comparison data clearly and fairly. The data we display, including fund fees, performance and risk indicators, is sourced from third parties such as product disclosure statements, fund updates and provider disclosures. We show the period or date the information reflects. Data can be incomplete, delayed or change after we publish it. Past performance is not a reliable indicator of future performance.
Where we display a reliability score, the following explainer applies.
Reliability score explainer. The reliability score is a number from 0 to 100 made up of four sub-components: [insert sub-component 1], [insert sub-component 2], [insert sub-component 3] and [insert sub-component 4]. It is calculated from [insert data sources] and reflects information as at [insert as-at date or period]. The score is a comparison aid, not a recommendation in itself, and not a guarantee of future performance. It does not take your personal circumstances into account.
You should not treat a comparison or a reliability score as a recommendation to choose, keep or leave any fund. Always consider your own circumstances and read the relevant product disclosure statement before deciding.
Switching
If you ask us to help you switch KiwiSaver provider or fund, you authorise us to act on your instructions and to share the information needed to complete the switch with the provider involved. You are responsible for the accuracy of the information you give us. A switch is your decision. We will help you understand the consequences, but switching can have effects on matters such as fees, the investment mix, tax through your prescribed investor rate, and timing. You should make sure you understand these before you proceed. The provider, not Kāhu, processes the switch and operates your KiwiSaver account.
Fees and how we are paid
[Confirm the fee and remuneration model before publishing.] Kāhu is currently provided to you [at no cost / for the fees set out at insert link]. Financial Advice NZ Limited is remunerated by [insert, for example: fees you pay us, and/or commissions or payments from third parties]. Where we receive a payment that could influence our advice, we manage the conflict in line with our duties and disclose it in our full disclosure information at [insert link]. We will tell you about any fees you would pay before you incur them.
Your responsibilities
When you use Kāhu you agree to:
- Provide accurate information when you ask for advice or help to switch.
- Use the site only for lawful purposes and your own personal KiwiSaver decisions.
- Not interfere with the site, attempt to gain unauthorised access, scrape data at scale, or use the site in a way that could damage or disrupt it.
- Not rely on general information as if it were personalised advice.
Intellectual property
The Kāhu name, logo, content, design and the compilation of comparison data are owned by or licensed to Financial Advice NZ Limited. You may view and use the site for your own personal, non-commercial KiwiSaver decisions. You may not copy, republish or commercialise our content or data without our written permission. Third party data and trade marks remain the property of their owners and are used with permission or under licence.
Availability of the site
We aim to keep Kāhu available and accurate, but we do not promise it will always be available, uninterrupted or error free. We may change, suspend or withdraw features at any time. We may also suspend or end your access if you breach these terms.
Our responsibility to you
We provide our services with reasonable care and skill. Nothing in these terms limits or excludes rights you have under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986, which cannot be contracted out of where you are a consumer.
Subject to those rights, and to the extent the law allows:
- We are not liable for any loss arising from your reliance on general information, third party data, or a reliability score, where that reliance was not based on personalised advice we gave you.
- We are not liable for the acts, omissions, products or performance of any KiwiSaver provider.
- We are not liable for indirect or consequential loss, or for loss caused by events outside our reasonable control.
[The limitation of liability and any indemnity must be reviewed and settled by a qualified New Zealand solicitor before publication. See reviewer note.]
Suspension and termination
You can stop using Kāhu at any time. We may suspend or end your access if you breach these terms or if we reasonably need to for legal, security or operational reasons. Provisions that are intended to survive, such as intellectual property, liability and dispute resolution, continue after your use ends.
Complaints and dispute resolution
If something goes wrong, please contact us first so we can try to put it right. Contact [insert complaints email or link]. If we cannot resolve your complaint, you can refer it to our approved dispute resolution scheme at no cost to you:
- Scheme: [insert approved scheme, for example FSCL, IFSO, FDRS or FDR]
- Membership number: [insert]
- Contact: [insert scheme contact details]
Our dispute resolution scheme provides a free, independent service to help resolve complaints we cannot resolve directly.
Governing law
These terms are governed by New Zealand law, and you and we submit to the non-exclusive jurisdiction of the New Zealand courts.
Changes to these terms
We may update these terms from time to time. The version date appears at the top. Your continued use of Kāhu after we publish a change means you accept the updated terms. Where a change is significant, we will take reasonable steps to bring it to your attention.
Reviewer note
This is a draft for human review. It is not legal advice. Please have the licensed adviser and a qualified New Zealand solicitor review and sign off before publication.
Assumptions and placeholders to confirm:
- Registered address, postcode, contact email and full disclosure link.
- The fee and remuneration model, including any commissions, and how conflicts are managed and disclosed. This is a lawyer escalation item under the project rules (new fee model, referral arrangement or conflict).
- The approved dispute resolution scheme, membership number and contact details.
- The four reliability score sub-components, data sources and as-at date. These are not published on the current site, so the explainer uses placeholders. Do not publish invented sub-components. If the score is not yet live, remove or hold the reliability score clauses until the methodology is confirmed.
- Whether KiwiSaver members under 18 are in scope.
Items flagged for legal sign off: the limitation of liability and any indemnity, which must be drafted consistently with the Consumer Guarantees Act 1993 and Fair Trading Act 1986 and cannot exclude consumer rights. Verify current financial advice disclosure obligations and the dispute resolution scheme details before publishing.
